1. Acceptance of Terms

By accessing or using FitWard AI, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you do not meet this requirement or do not agree to these Terms, you must not use the Service.

2. Your Account

You sign in to FitWard AI using a third-party provider such as Google or GitHub. You are responsible for maintaining the security of the connected account and for all activity that occurs under your FitWard AI profile. You must notify us immediately at info@fitward.ai if you suspect unauthorized access to your account.

3. Subscriptions and Billing

FitWard AI offers a free Starter plan and paid subscription plans. Current plan names, features, and prices are shown below and may be updated from time to time.

• Payment method: All paid subscriptions are settled exclusively via cryptocurrency. We do not currently accept credit cards, bank transfers, or other traditional payment methods. By subscribing to a paid plan, you acknowledge the irreversible nature of cryptocurrency transactions.
• Billing cycles: Paid subscriptions renew automatically at the end of each billing period (monthly, quarterly, or annual, as selected at checkout) until cancelled.
• Cancellation: You may cancel at any time from your account settings. Your paid plan remains active until the end of the current billing period, after which your account reverts to the free Starter plan.
• Refunds: Due to the irreversible nature of cryptocurrency transactions, all payments are final and non-refundable, except where required by applicable law. If you believe a payment was made in error, contact us at info@fitward.ai within 7 days.

4. Acceptable Use

When using FitWard AI, you agree not to:

• Upload content you do not have the right to use.
• Submit false, misleading, or fraudulent information in a resume or elsewhere on the Service.
• Attempt to disrupt, reverse engineer, scrape, or gain unauthorized access to the Service or its underlying infrastructure.
• Use the Service to generate content that is unlawful, harmful, defamatory, or infringing of third-party rights.
• Resell, sublicense, or otherwise commercially exploit the Service without our written permission.

5. AI-Generated Content

FitWard AI uses AI to suggest and improve resume content. These suggestions are provided as a starting point only. You are solely responsible for reviewing, editing, and verifying the accuracy of all content before using it in any job application or other context. We make no guarantees about the fitness, accuracy, or outcome of AI-generated suggestions.

6. Intellectual Property

You retain full ownership of the resume content you create or upload. FitWard AI retains all rights to the platform, software, visual design, and branding. You grant us a limited, non-exclusive license to process your content solely to provide the Service to you. This license ends when you delete your content or close your account.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI suggestions will result in any particular employment outcome.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FitWard AI shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid for the Service in the three months preceding the claim.

9. Termination

You may stop using FitWard AI at any time by closing your account. We may suspend or terminate your access if you violate these Terms or use the Service in a way that poses a risk to other users or to the platform. Upon termination, your data will be handled in accordance with our Privacy Policy.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which FitWard AI operates, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or, where arbitration is not enforceable, to the courts of competent jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the Service or by email at least 7 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
